daj060454 Posted January 5, 2009 Share Posted January 5, 2009 I acquired one of these from Empire Direct on Saturday, it’s a fantastic piece of equipment and I am very impressed with the picture quality and overall performance, this set comes out very well in all consumer reviews. I have spent a considerable amount of time researching it to make sure I got the right one! Unfortunately the element I didn’t include in my calculations was that SWMBO doesn’t want a screen that big and can we please send it back! Empire direct are fine with that, but want to charge me 15% of the purchase price to swop as I have opened the packaging. I thought that there may be someone out there who might be interested, The TV has been on for about eight hours and has not had the postcode or any of the guarantee documents registered yet. The TV comes with a full five year guarantee from Panasonic (As I ordered it before 31 December) I would be happy to cut my losses and part with it for £470. Clearly it’s a big package, so would be suitable for pick up only. I live in Lichfield, Staffordshire. However, if you want to insist on your rights under the Distance Selling Act, you are perfectly entitled to open the package to examine the goods before returning them, regardless of what ED's conditions say. The DSRs allow consumers to examine goods they have ordered as they would in a shop. If that requires opening the packaging and trying out the goods then they have not breached their duty to take reasonable care of the goods. In these circumstances you cannot insist that consumers return the goods as new or in their original packaging. You may ask consumers to return goods with the original packaging, but you cannot insist on this. In the case of goods such as earrings that have hygiene seals, you may require consumers to exercise reasonable care by not removing the seals when examining them. I find that the set will look big to start with but you soon get used to it. Of all the reasonable money 42" Plasmas I looked at, it was the best with a cracking picture on Freeview and DVD's. And you are only 15 miles away....Such is life..... Good luck with the sale.
